Terms of Service
These Terms of Service govern your use of houseofmathebula.co.za and purchases made from House of Mathebula. By using this website or placing an order, you agree to these Terms of Service together with our Privacy Policy, Refund Policy and Shipping Policy.
1. About House of Mathebula
House of Mathebula is a trading name of Gap Digital Group (Pty) Ltd.
2. Products
We aim to display and describe our products as accurately as reasonably possible. Colours and appearance may vary slightly depending on your device, screen settings, photography and manufacturing variations.
Product availability may change without notice. We reserve the right to discontinue products or limit quantities where reasonably necessary.
Some products are sourced and fulfilled through third-party fulfilment partners and may be dispatched directly to customers from locations outside South Africa.
3. Pricing and Payment
Prices are displayed in South African Rand (ZAR) unless otherwise indicated.
The total amount payable to House of Mathebula will be displayed before you complete payment.
We reserve the right to correct genuine pricing, product-description or technical errors. If an error affects an order already placed, we will contact you before proceeding where reasonably possible.
4. Orders
Placing an order constitutes an offer to purchase the selected products. An order is accepted once it has been confirmed and processed by House of Mathebula.
We may cancel or decline an order where reasonably necessary, including where a product is unavailable, there has been an obvious pricing or technical error, payment cannot be verified, or fraudulent or unlawful activity is reasonably suspected.
If we cancel an order after receiving payment, any amount due to you will be refunded using the appropriate payment method.
5. Shipping and Fulfilment
Shipping, fulfilment and estimated delivery times are governed by our Shipping Policy.
For products advertised with free standard delivery, standard shipping has been factored into the product pricing and no separate standard delivery charge will be imposed by House of Mathebula unless otherwise displayed before checkout.
Delivery estimates are estimates rather than guaranteed delivery dates and can be affected by fulfilment partners, couriers, customs processing and circumstances outside our reasonable control.
6. Customs, Import VAT and Other Charges
Some products may be shipped from outside South Africa.
Orders entering South Africa may be assessed for customs duties, import VAT, courier clearance fees or other import-related charges. These charges are separate from shipping charges and are not included in the price unless House of Mathebula expressly states otherwise.
Where such charges are assessed, they are the customer's responsibility and may need to be paid to the relevant authority, courier or clearance agent before delivery can be completed.
International customers may likewise be responsible for duties, taxes or clearance charges imposed by authorities in their destination country.
7. Returns, Refunds and Consumer Rights
Returns and refunds are handled according to our Refund Policy and applicable South African law.
Nothing in these Terms is intended to exclude, restrict or waive any consumer right that cannot lawfully be excluded or restricted.
8. Defective or Incorrect Goods
If goods arrive damaged, defective or materially different from what was ordered, customers should contact us as soon as reasonably possible at hello@houseofmathebula.co.za.
Any rights or remedies available under applicable consumer-protection legislation remain unaffected by these Terms.
9. Customer Information
Customers are responsible for ensuring that information supplied when placing an order, including contact and delivery information, is complete and accurate.
Additional costs or delays caused by incorrect or incomplete customer-supplied delivery information may be the customer's responsibility where permitted by law.
10. Intellectual Property
The House of Mathebula name, branding, logo, website design, original text, graphics and other original content belonging to House of Mathebula or Gap Digital Group (Pty) Ltd may not be copied, reproduced or commercially used without permission, except where permitted by law.
Third-party trademarks and other intellectual property remain the property of their respective owners.
11. Website Use
You may not knowingly use this website for unlawful, fraudulent or malicious purposes, interfere with the operation or security of the website, or attempt unauthorized access to systems associated with the website.
12. Third-Party Services
Our store is hosted using Shopify and may use third-party services for payments, fulfilment, shipping, analytics and other functions.
Your use of certain third-party services may also be subject to those providers' applicable terms and privacy practices.
13. Liability
To the extent permitted by law, House of Mathebula and Gap Digital Group (Pty) Ltd will not be responsible for indirect or consequential losses arising from circumstances outside our reasonable control.
Nothing in this section excludes or limits liability where doing so would be prohibited by applicable law.
